GOVERNING
DOCUMENTS
The following six documents establish the La Viña
Homeowners Association, regulate its operation, and promulgate
the benefits and obligations of homeowners.
Articles
of Incorporation.
Executed April 23, 1997. This document establishes the Association
as a California nonprofit mutual benefit corporation.
By-Laws.
Adopted April 24, 1997. This document delineates the organizing
framework and operating processes of the Association. A
minor change to provisions
was adopted January 31, 2005.
Declaration
of Restrictions.
Recorded May 13, 1997. This document specifies the covenants,
conditions and restrictions (CC&Rs) imposed on homeowners
and the Association. Textual errors in the Declaration were
removed in an amendment
recorded March 4, 1998. Provisions of Section
11.4(a) were changed in an amendment recorded August
19, 2005.
Architectural
and Landscaping Guidelines.
Dated
November 5, 2002 and corrected September 12, 2005. This
document specifies requirements and processes for Architectural
Review Committee approval of homeowner architectural and
landscaping improvements.
Rules
and Regulations. Adopted February 6, 2002,
revised January 31, 2005, and approved for website publication
on February 28, 2005. This document sets forth the essential
policies and requirements that ensure orderly community
living and the safeguarding and maintenance of property
held in common by homeowners.
Tract
Maps.
Recorded between December 24, 1996, and August 19, 1998,
these documents establish the homeowners association, define
its membership, and identify its property. The 15 La Viña
tract map drawings also show the location and boundary of
every La Viña lot, and are therefore connected to
every homeowner deed and mortgage.
